Statement of Compliance

IslaFans LLC, a Delaware limited liability company (“IslaFans”), operates the platform at islafans.com. IslaFans requires that all content posted to the platform that contains sexually explicit depictions complies fully with the requirements of 18 U.S.C. § 2257 and its implementing regulations at 28 C.F.R. Part 75.

Content Produced by Third-Party Creators

IslaFans is an interactive computer service platform as defined by 47 U.S.C. § 230. The sexually explicit content available on IslaFans is produced exclusively by third-party content creators (“Creators”) who are independent contractors, not employees or agents of IslaFans.

Each Creator who posts sexually explicit content to IslaFans represents and warrants to IslaFans, as a condition of using the platform, that:

• All performers depicted in any sexually explicit content are at least 18 years of age at the time the content was produced;
• The Creator has inspected valid, government-issued photo identification for each performer and confirmed that each performer is 18 years of age or older;
• The Creator maintains or has immediate access to all records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 for all performers depicted in their sexually explicit content;
• Such records are available for inspection at the address designated in this statement.

Records Maintained by IslaFans

In addition to the records maintained by individual Creators, IslaFans maintains the following records in connection with the identity verification process required of all Creators before they may publish content on the platform:

• A copy of each Creator's valid, government-issued photo identification confirming their legal name and date of birth;
• The date on which the identity document was reviewed;
• The Creator's confirmed date of birth and age at the time of verification;
• Any legal name or performing name used by the Creator on the platform.

These records are retained for the period required by law — currently seven (7) years from the date the content was last offered for sale or distribution, or until two years after the last production date, whichever is longer, in accordance with 28 C.F.R. § 75.2.

Age Verification Requirement

IslaFans requires all Creators to undergo identity verification before their account is approved to publish content. No Creator may publish sexually explicit content before verification is complete. Content that is found to depict a minor or that lacks verifiable age records is removed immediately, the account is permanently terminated, and the matter is reported to the National Center for Missing & Exploited Children (NCMEC) and appropriate law enforcement.

Inspection of Records

Records maintained pursuant to 18 U.S.C. § 2257 and 28 C.F.R. Part 75 are available for inspection at the address of the Custodian of Records listed above. Requests for inspection must be submitted in writing to the Custodian of Records and must comply with the procedures set forth in 28 C.F.R. § 75.5. IslaFans will make records available for inspection during normal business hours within the time period required by applicable regulations.

Exemption Notice

To the extent that any content on IslaFans does not depict sexually explicit conduct as defined by 18 U.S.C. § 2256(2), this statement is not applicable to such content. IslaFans makes no representation that all content on the platform is subject to 18 U.S.C. § 2257, and the presence of this statement does not constitute an admission that any particular content is so subject.
